TERMS OF SERVICE
These Terms of Service govern your use of the DNA Aquatic online store and purchases made from DNA Aquatic. By visiting our store or placing an order, you agree to these Terms and our posted Refund, Shipping, Privacy, and other store policies.
STORE USE
You agree to provide accurate, complete, and current account, billing, payment, and shipping information.
You may not use our store for any unlawful, fraudulent, abusive, or unauthorized purpose. You may not interfere with the security, operation, or availability of the store.
PRODUCTS AND LIVESTOCK
The appearance, coloration, markings, size, and behavior of livestock can vary naturally. Unless a product listing specifically states that the pictured animal is the exact animal being sold, photographs may be representative of the species or variety.
Product descriptions and care information are provided for general informational purposes. Customers are responsible for determining whether livestock is appropriate for their aquarium, including tank size, water parameters, compatibility, diet, care requirements, and local legal restrictions.
Customers are responsible for proper acclimation, quarantine, housing, and continuing care after delivery.
ORDERS AND PAYMENT
All orders are subject to availability, acceptance, and payment verification. Placing an order does not guarantee that every item will remain available.
DNA Aquatic may correct errors involving pricing, inventory, product descriptions, or availability. We may refuse or cancel an affected order. If payment has already been collected for an order that we cancel, the applicable amount will be refunded or credited as required.
SHIPPING
Livestock and dry-good shipping are governed by our Shipping Policy. Shipping and delivery dates are estimates unless expressly stated otherwise.
Customers are responsible for supplying an accurate delivery address, monitoring tracking information, and receiving livestock promptly.
RETURNS AND DOA CREDITS
Livestock sales are final except for eligible Dead on Arrival claims.
Clear photographs of livestock that is dead on arrival must be submitted within 24 hours of the shipment’s recorded delivery time. Approved DOA claims receive store credit for the affected livestock toward the customer’s next order.

INTELLECTUAL PROPERTY
The DNA Aquatic name, branding, original photographs, graphics, product descriptions, and other original store content may not be copied, reproduced, distributed, or commercially used without permission, except as allowed by law.
THIRD-PARTY SERVICES
Our store may use third-party services, including Shopify, payment processors, and shipping carriers. Those services may be governed by their own terms, policies, and privacy practices.
DISCLAIMER AND LIMITATION OF LIABILITY
To the fullest extent permitted by law, DNA Aquatic is not responsible for indirect, incidental, special, or consequential losses resulting from use of the store, carrier delays, improper acclimation, incompatible livestock, unsuitable aquarium conditions, or animal care after delivery.
Nothing in these Terms excludes liability or customer rights that cannot legally be excluded or waived.
INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold DNA Aquatic harmless from claims resulting from your unlawful use of the store, violation of these Terms, or violation of another person’s rights.
CHANGES TO THESE TERMS
DNA Aquatic may update these Terms by posting a revised version on the store. Continued use of the store after an update constitutes acceptance of the revised Terms where permitted by law.
SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect.
GOVERNING LAW
These Terms are governed by the laws of the State of Indiana and applicable federal law, without limiting any non-waivable consumer protections.
